Conditions of Use

The terms and conditions (“AGB”) apply to the sales and shipping of goods by Weingut Schenter with business location and company address at A-3562 Schönberg, Thürneustift 6.

Variations from these conditions are valid only if stated in writing and expressly confirmed by an authorized person of Weingut Schenter.

After placing an order, the buyer declares that he agrees with the terms of the “AGB” and becomes bound by them.


The amounts stated are quoted exclusive the respective delivery charges.

The delivery charges within Austria are calculated in accordance with following scheme: Package incl. VAT: 3 Fl = 7,20 EUR, 6 FL = 8,40 EUR, 12 FL = 10,80 EUR

Shipping of the goods takes place against prepayment.

Prices are based on the date of the order.


The purchase price of the goods is due as soon as you have placed the order and is payable in advance.

Weingut Schenter reserves ownership to all goods until the purchase price has been paid in full together with all ancillary fees.

Transfer of Risk

The buyer declares his consent for the delivery by a delivery service and shall bear all risks from the time when the goods are handed over to the respective delivery service.

Withdrawal from the contract, Delivery

Provided that the customer is consumer in accordance with the Consumer Protection Act and placed the order via the Internet Online-Shop, the buyer can – in accordance with §5h KSchG – withdraw from the contract within 7 days from the date of delivery either in written form or by returning the goods. The withdrawal does not require justification as long as dispatched on time. Against return of the delivered goods the total amount paid by the buyer will be reimbursed. The costs for the return will be borne by the buyer.

Delivery takes place via a delivery service appointed by us during normal business hours. In the case of non-acceptance of ordered goods we shall be entitled to claim for the additional costs incurred e.g. frustrated expenses.


Warranty claims require that defects occurred must be immediately reported to Weingut Schenter, namely recognisable defects immediately on receipt of the goods, any concealed defects immediately upon detection and on presentation of the original bill.

A warranty claim shall be restricted to the purchase price of the defective goods delivered.

Warranty claims will be satisfied by the shipment by goods free from any defects, improvements or delivery of shortfalls.

All warranty is excluded after tasting, consumption or any start of any processing of the delivered goods.

Compensation for Damages

The liability within the framework of statutory provisions is limited to 10% of the value of the goods.

We exclude all liability for consequential damage and other property damage or financial damage and claims from third parties against the purchaser. Transactions with consumers shall fall under the obligatory provisions of the Consumer Act (KSchG).

Customer Data

The customer agrees that the customer data stated in the contract will be in accordance with the requirements of the Data Protection Law stored and processed. Weingut Schenter will use the information to ensure compliance with statutory provisions for the processing of payment transactions and for customer care.

Other Provisions

Should individual clauses of the contract with our customer including these General Terms of Business or special agreements become ineffective, it shall not automatically cause the invalidity or ineffectiveness of the entire contract. The remainder of the contract remains unchanged, therefore legally binding.

Place of performance of the contract is for both Weingut Schenter and for the buyer A- 3562 Schönberg, Thürneustift 6

For decision of all disputes resulting from the contract exclusively the district court of Krems is responsible.
